MESSAGE FOR MEMBERS AND NON-MEMBERS OF THE MEXICAN CINEMATOGRAPHER SOCIETY, AMC, REGARDING PLAGIARISM OF WORK
The AMC is an association that protects the authors’ and its members’ rights. The AMC deeply repudiates any act that may harm the author’s recognition or the author’s right respect.
This association acknowledges that Mr. ROBERTO GARZA RUIZ GOMAR, in order to be considered a member, showed a demo reel which is not of his complete authorship.
However, after getting an initial approval, and after a more in-depth investigation, the Board of Directors and the Committee of Honor and Justice determined that Mr. GARZA RUIZ GOMAR is not the original author of the work he presented to be admitted and the one he uses in his social networks and on his webpage. We attach some examples of more than 30 photos and videos which have been gathered from their original authors with their answer to their work and their respective comments. Pursuant to the Federal Law of Author’s Rights, the AMC acknowledges the application of the principal of good faith. This principle highlights that their work have protection from the moment they are supported in any kind of media, independently of their merit, destiny and mode of expression. That is to say that the work, independently of its registry, has legal protection in favor of its author and until proven otherwise.
On the other hand, the Federal Criminal Code states that the crimes should be considered either by the unauthorized use of work, and with profit motives, as well as the publication of work
replacing the author’s name by another one. This association considers that the misconduct carried out by Mr. ROBERTO GARZA RUIZ GOMAR would be included in such cases.
The AMC has no legal capacity to act against Mr. ROBERTO GARZA RUIZ GOMAR; however, as his conduct does not respect the ethical principles and the ethical standards which govern it, consequently, this public REPUDIATION is carried out due to this kind of act, and according to the bylaws of our statutes Article SEVENTEEN, section III, IV and V, ROBERTO RUIZ GOMAR is definitely expelled as member, and from this day, he is revoked of his rights as member, and he will not be able to enjoy the respective benefits, since he did not show the authorship of his work presented to the AMC even when he signed the authorship responsive letter in his admission about all the material presented to the Admission Committee.
As the AMC is an association that respects the author’s rights and follows the good practice and customs. We want to let members and the authors community in general know about this case so as to explain why we have decided to definitely expelled Mr. ROBERTO GARZA RUIZ GOMAR.
